Section 1. Scope of Work & Specification
Luxe Flooring agrees to supply the flooring materials and perform professional installation services specified in the Project Summary. Any changes, additions, or modifications to the scope of work must be agreed to in writing by both the Customer and an authorized Luxe Flooring representative through a signed Change Order.
Section 2. Contract Price & Total Investment
The total contract price set forth in this Agreement is all-inclusive of specified materials, standard preparation, and professional installation. Pricing is provided as a total contract sum; no price per square foot calculations or breakdowns apply to this Agreement.
Section 3. Payment Schedule & Financing Terms
Customer agrees to make payments in accordance with the selected payment plan or approved financing terms. If promotional financing is utilized (including 21 Months No Interest), Customer acknowledges receipt and agreement to the applicable lender's credit agreement and monthly minimum payment obligations.
Section 4. Subfloor Conditions & Moisture Assessment
Standard installation includes routine sweeping and minor subfloor prep. Unforeseen subfloor conditions, including but not limited to severe unevenness, extensive rot, moisture intrusion exceeding manufacturer tolerances, or structural framing defects requiring remediation will be documented and presented to Customer before additional work proceeds.
Section 5. Jobsite Readiness & Temperature / Acclimation
Customer agrees to provide safe access to the premises, working electricity, and an indoor climate maintained between 65°F and 75°F with 35%–55% relative humidity for at least 48 hours prior to, during, and after installation to ensure proper material acclimation and performance.
Section 6. Furniture Moving & Personal Property
Unless explicitly itemized as an included service in the Project Summary, Customer is responsible for clearing all small, fragile, valuable, or electronic items, clothing, and personal belongings from the work area. Luxe Flooring installers exercise reasonable care with designated large furniture pieces but assume no liability for pre-existing furniture defects.
Section 7. Existing Floor Removal & Disposal
Where removal is contracted, Luxe Flooring will remove and dispose of existing floor coverings indicated in the specifications. Concealed hazardous substances, including asbestos-containing adhesives or tiles, cannot be disturbed by installers and require certified third-party abatement at Customer expense.
Section 8. Installation Schedule & Delays
Luxe Flooring will make every reasonable effort to begin and complete work on the agreed dates. Luxe Flooring shall not be held liable for delays caused by severe weather, manufacturer material backorders, freight interruptions, acts of God, or other conditions beyond reasonable operational control.
Section 9. 4-Part Lifetime Guarantee & Warranty Terms
Customer is entitled to the Luxe Flooring 4-Part Lifetime Guarantee covering Lifetime Labor, Gap-Free Guarantee, 5-Plank Guarantee®, and Love-It or Leave-It Guarantee®, subject to proper routine care, residential indoor use, and adherence to manufacturer maintenance guidelines.
Section 10. Low-Price Guarantee Conditions
If Customer presents a written quote from a licensed and insured local flooring competitor for identical first-quality product, equivalent professional installation, and matching warranty coverage within thirty (30) days of signing, Luxe Flooring will beat that competitor's price.
Section 11. Natural Variations & Material Characteristics
Wood, luxury vinyl, and laminate products feature natural graining, color shading, character marks, and texture variations. Samples represent approximate appearance only; finished planks installed throughout the living area will display authentic batch-to-batch variation inherent to quality flooring.
Section 12. Customer Walkthrough & Final Inspection
Upon completion of installation, Customer (or an authorized adult representative) agrees to participate in a final walkthrough with the lead installer to inspect the completed work and sign the Certificate of Satisfaction.
Section 13. Notice of Cancellation Rights
Customer has the right under federal and state law to cancel this transaction without penalty at any time prior to midnight of the third business day after the date of this Agreement by providing written notice to Luxe Flooring at sales@luxeflooring.net or 513-778-8000.
Section 14. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio. Any controversy or claim arising out of or relating to this contract shall first be submitted to good-faith mediation before formal dispute proceedings in Hamilton County, Ohio.
Section 15. Entire Agreement & Severability
This Agreement constitutes the entire agreement between Luxe Flooring and the Customer and supersedes all prior negotiations, representations, or oral agreements. If any provision of this contract is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Signatures & Acceptance
By signing below, Customer acknowledges reading, understanding, and initialing Sections 1 through 15 of this Agreement, and agrees to all terms and conditions set forth herein.
